Legal framework

The laws regulating trademarks in the UAE were enacted in the year 1992 under Federal Law No. 37, which was later updated by Law No. 19 of 2000 and Law No. 8 of 2002. 

All seven Emirates of the United Arab Emirates—Abu-Dhabi, Dubai, Sharjah, Ras Al-Khaimah, Ajman, Fujairah, and Umm Al-Quwain—are covered by the law.

Classification of Goods and Services: 10th Edition of Nice Classification (NCL).

Opposition Period: 60 days from the publication date. Extension of the opposition period is not possible. 

Protection Period: 10 Years. 

Renewal: A registered mark is renewable for successive periods of 10 years within the last year of protection. 

Grace Period for Renewal: A grace period of 3 months is allowed for the renewal with a lateness fine following the expiry of the registration period.

Use of trademarks: It is not compulsory for registration or maintaining the registration in force. However, any interested party can lodge a request to cancel the mark at the court of jurisdiction if the mark has not been used for five (5) consecutive years after registration. 

Mandatory Documentation

TM Registration
  1. A Power of Attorney filled with the full name and address of the applicant, duly notarized and legalized up to the UAE Consulate.
  2. A simple copy of the certificate of incorporation, or Business License, or an extract of the commercial register along with Arabic translation. If the applicant is an Individual, a Passport copy of the applicant is required.
  3. List of goods/services to be covered by the application indicated in Nice classification, 10th Edition.
  4. Soft copy of the trademark.
  5. In case of claiming priority, a certified copy of the priority application.
TM Renewal
  1. A Power of Attorney notarized and legalized up to the UAE Consulate.
  2. A scanned copy of the registration certificate.
Recordal of Assignment/Merger/License Agreement
  1. A Power of Attorney duly notarized and legalized up to Saudi Consulate or attested by Apostille.
  2. A Deed of Assignment/License agreement legalized up to the UAE Consulate.
  3. Original Registration Certificate for the purpose of endorsement.
Name Change or Address Change Recordal
  1. A Power of Attorney showing the new name and/or address duly notarized and legalized up to the UAE Consulate.
  2. Certificate of change of name/address (which is applicable) legalized up to the UAE Consulate.
  3. Original Registration Certificate for the purpose of endorsement.

Trademark Registration Procedure

Once the trademark application is filed, the Trademark Office will issue a filing receipt showing the filing number and date, and other relevant details. We will provide you with a copy of the receipt and application as filed with our formal report. 

The application will be subject to examination. This stage will determine if your mark is acceptable, conforms to local laws and does not conflict with any prior existing registrations or applications. Trademark applications are examined in the order of application numbers. An application may remain pending examination for approximately 4 to 6 months, depending on the work backlog at the Trademark Office. However, currently, the UAE TMO has accelerated the examination procedure, as the Examination results are notified within 1 to 2 weeks. The Examiner can either accept or reject the application depending on the result of such examination. 

If accepted, the trademark will be published in the UAE Trademark Journal and two local newspapers after the payment of publication fees. 

If rejected, the applicant will have the option to file an appeal with the Trademark Office against the rejection decision within 30 days from its issuance. 

The purpose of the publication is to give notice to the public that the mark is about to be registered and to allow any interested parties to oppose the registration. The period open for opposition will be 30 days from the publication date. In the event of an opposition, the applicant may file a counterstatement regarding the points on which the opposition is based. 

Upon successful completion of the opposition period without any opposition filed against your application, the electronic certificate of registration will be issued.
