Regulatory Body

Trademark Registration in Kuwait is governed by the Trademarks and Patents Department under the Ministry of Trade and Industry.

Legal framework

Decree-Law No. 68 of 1980, which was amended by Decree-Law No. 10 of 1987, and Law No. 1 of 2001 were the governing Laws of Trademarks in Kuwait.  However, the Ministerial Decision No. 500 of 2015 (published in the Official Gazette on December 27, 2015) was issued pursuant to Law No. 13 of 2015 approving the Trademarks Law of the Gulf Cooperation Council States (the GCC Trademarks Law).

Classification of Goods & Services: Strictly as specified in Nice Classification (NCL) 11th Edition (2017 version).

Opposition Period: 60 days from the publication date. Extension of the opposition period is not possible. 

Protection Period: 10 Years. 

Renewal: A registered mark is renewable for successive periods of 10 years within the last year of protection. 

Grace Period for Renewal: A grace period of 6 months is allowed for the renewal with a lateness fine following the expiry of the registration period.

Use of trademarks: It is not compulsory for registration or maintaining the registration in force. However, mark is vulnerable to cancellation action by any interested party if the mark has not been used for five (5) consecutive years after registration. 

Mandatory Documentation


TM Registration
  1. A Power of Attorney filled with the full name and address of the applicant, duly notarized and legalized up to Kuwaiti Consulate.
  2. A simple copy of the Commercial Registration (CR) certificate (Not mandatory for Foreign Applicants).
  3. List of goods/services to be covered by the application strictly as indicated in Nice classification 11th Edition (2017 version).
  4. Soft copy of the trademark.
  5. In case of claiming priority, a certified copy of the priority application along with its Arabic translation.
TM Renewal
  1. A Power of Attorney from the TM owner, duly notarized and legalized up to Kuwaiti Consulate.
  2. A copy of the registration certificate of the mark.
Name Change/Address Change Recordal
  1. A Power of Attorney showing the new name and/or address, duly notarized and legalized up to Kuwaiti Consulate.
  2. Certificate of change of name and/or address (which are applicable), duly legalized up to Kuwaiti Consulate.
  3. A copy of Registration Certificate of the mark.

NB: We require only e-copy of aforesaid documents.

Recordal of Assignment/Merger
  1. A Deed of Assignment/License agreement, duly legalized up to Kuwaiti Consulate.
  2. A Power of Attorney executed by the Assignee/Licensee, duly notarized and legalized up to Kuwaiti Consulate.
  3. A copy of Registration Certificate of the mark.
