Regulatory Body

The Directorate of Industrial Property under the Ministry of Industry, Commerce and Tourism is the governing body for Trademark Registration in Bahrain.

Legal framework

The GCC Trademarks Laws are implemented in Bahrain by the Law No. 6 of 2014 in accordance with the decision No. 65 of 2016 issuing the Implementing Regulation for GCC TM Laws.

As Bahrain is a member state to the Madrid Protocol, the extension of an international trademark registration via the Madrid System is possible.

Classification of Goods and Services: 11th Edition of Nice Classification (NCL).

Opposition Period: 60 days from the publication date. Extension of the opposition period is not possible. 

Protection Period: 10 Years. 

Renewal: A registered mark is renewable for successive periods of 10 years within the last year of protection. 

Grace Period for Renewal: A grace period of 6 months is allowed for the renewal with a lateness fine following the expiry of the registration period.

Use of trademarks: It is not compulsory for registration or maintaining the registration in force. However, as per Article 24 of GCC Trademark Laws, any interested party can lodge a request to cancel the mark at the court of jurisdiction if the mark has not been seriously used for five (5) successive years. 

Mandatory Documentation

TM Registration
  1. A Power of Attorney filled with the full name and address of the applicant, duly legalized up to the Bahraini Consulate or authenticated by the Apostille.
  2. Certificate of Incorporation, or Business License, or an extract of the Commercial Register which should include the name, address, date of incorporation and objectives of the corporation, duly legalized up to the Bahraini Consulate or authenticated by the Apostille.
  3. A certified copy of the priority document (in case of claiming priority).
  4. Description of the goods or services to be covered by the application.
  5. Clear prints of the mark.
TM Renewal
  1. 1. A Power of Attorney legalized up to the Bahraini Consulate or authenticated by the Apostille.
  2. A copy of the registration Certificate or Trademark registration number.
Name Change/Address Change Recordal
A Power of Attorney in the new name and/or address of the applicant duly legalized up to the Bahraini Consulate or authenticated by the Apostille.
  1. A letter from the owners addressed to the Registrar of trademarks in Bahrain stating their request to effect the change of name and/or address (prepared by us).
Recordal of Assignment/Merger
  1. A Deed of Assignment legalized up to the Bahraini Consulate or authenticated by the Apostille.
  2. A legalized Power of Attorney from the Assignee.
  3. Original Registration Certificate for the purpose of endorsement.
